Terms of Service

By booking our services or using our website, you agree to these Terms of Service. Please read them carefully.

1. Services

Today Realty provides real estate photography, video production, drone/aerial photography, virtual staging, 360 tours, floor plans, and related marketing services in North Carolina. Specific services and deliverables are defined at the time of booking.

2. Booking & Payment

Booking: Services are confirmed upon receipt of a completed booking form and, where applicable, payment. We reserve the right to decline any booking at our discretion.

Payment: Payment terms are provided at time of booking. Payment is due per the schedule outlined in your booking confirmation. We accept major credit cards and bank transfers.

Pricing: Prices listed on our website are starting prices and may vary based on property size, location, travel requirements, and selected services. Final pricing is confirmed at booking.

3. Cancellations & Rescheduling

Cancellations: Cancellations made 48+ hours before the scheduled shoot will receive a full refund or credit. Cancellations made within 48 hours of the shoot may be subject to a cancellation fee of up to 50% of the booking value.

Rescheduling: We allow one reschedule at no charge with 24+ hours notice. Additional rescheduling or same-day cancellations may incur a fee.

Weather: For drone/aerial services, we may reschedule if weather conditions are unsafe for flight at no penalty to either party.

Property Access: The client is responsible for ensuring the property is accessible and ready at the scheduled time. If access is not available at the scheduled shoot time, a return-trip fee may apply.

4. Delivery

We target 24-hour delivery for standard photography packages from shoot completion. This is our standard service level and not a guaranteed contractual deadline unless specifically stated in a written agreement. Rush delivery options may be available for an additional fee.

Media is delivered via online gallery or download link. Links are valid for 90 days from delivery. We are not responsible for re-delivery after link expiration without a re-delivery fee.

5. Licensing & Usage Rights

Upon full payment, Today Realty grants the client a non-exclusive, non-transferable license to use the delivered media for the purpose of marketing the specific property photographed. This includes MLS listings, social media, email marketing, and personal/broker websites.

Restrictions: The client may not: sell or transfer media to third parties; use media to market properties other than the photographed property without written permission; remove or alter our watermarks (where applied); or use media beyond the licensed purpose without a separate licensing agreement.

Today Realty retains full copyright ownership of all media produced. We reserve the right to use delivered media for our portfolio, website, social media, and marketing materials.

6. Drone & Aerial Services

Our drone pilots are FAA Part 107 certified. By booking drone services, you confirm that: the property is not located in restricted airspace; no temporary flight restrictions (TFRs) are in effect; and you have obtained any necessary property owner permissions. Today Realty is not responsible for delays or cancellations due to airspace restrictions or weather.

7. Virtual Staging

Virtual staging is provided as a complimentary enhancement to photography packages. Virtually staged images are digitally altered photos intended to show potential furniture placement. These images must be clearly labeled as "virtually staged" when used in MLS listings or marketing materials, as required by MLS rules. The client assumes responsibility for proper disclosure.

8. Limitation of Liability

Today Realty's liability for any claim arising from our services is limited to the amount paid for the specific services giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

We are not responsible for lost business, failed transactions, or any outcome related to the marketing performance of your listing.

9. Property Preparation

The client is responsible for ensuring the property is clean, staged, and ready for photography at the scheduled shoot time. We are not responsible for image quality issues resulting from an unprepared property. Return visits due to property unreadiness may be charged at our standard rates.

10. Indemnification

You agree to indemnify and hold harmless Today Realty, its employees, and contractors from any claims, damages, or expenses arising from your use of our services or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of North Carolina. Any disputes arising from these Terms or our services shall be resolved in the courts of North Carolina.

12. Changes to Terms

We reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a revised date. Continued use of our services after changes constitutes acceptance.
